1. Acceptance of these terms

These Terms of Service, referred to as the "Terms," are a binding agreement between you and Hindsight Farms, referred to as "Hindsight Farms," "we," "us," or "our," concerning your use of hindsightfarms.com and any page that links to these Terms, collectively the "Site."

You represent that you are legally able to agree to these Terms. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Website purpose and information

The Site provides general information about Hindsight Farms, its facilities, boarding, training relationships, and ways to contact the farm. Site content is provided for informational purposes only. It is not an offer, promise, warranty, or guarantee that any service, stall, trainer, program, amenity, rate, appointment, or other opportunity is available.

We try to keep the Site accurate and current, but descriptions, photographs, dimensions, schedules, policies, personnel, availability, and other information may change without notice. Please contact us to confirm information that matters to your decision.

3. Farm services, safety, and property visits

Using the Site, sending an inquiry, or scheduling a conversation does not create a boarding, training, lesson, employment, agency, fiduciary, or other service relationship with Hindsight Farms or any trainer. Any farm service is subject to availability, approval, and a separate written agreement when applicable.

The Site does not provide veterinary, medical, legal, insurance, equine-care, safety, or other professional advice. Do not rely on Site content as a substitute for advice from a qualified professional who understands your specific circumstances.

Equestrian activities and visits to an operating farm can involve inherent risks. Access to the property is by permission and appointment only. Visitors must follow posted rules and all instructions from farm personnel. Separate waivers, releases, boarding agreements, trainer agreements, or visitor rules may apply and will control if they conflict with these Terms.

4. Permitted use

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for lawful, personal, and informational purposes. You may not:

• use the Site in violation of any law or the rights of another person;
• interfere with, damage, disable, or place an unreasonable burden on the Site or its security;
• attempt to gain unauthorized access to the Site, its hosting systems, forms, or related networks;
• introduce malware, automated spam, harmful code, or fraudulent submissions;
• scrape, copy, reproduce, republish, sell, or commercially exploit Site content without our written permission, except as allowed by law;
• misrepresent your identity, affiliation, or reason for contacting us; or
• use photographs, names, marks, or other Site content to imply endorsement or affiliation without written permission.

We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated or the Site, Hindsight Farms, or others may be harmed.

5. Intellectual property

The Site and its photographs, video, text, design, layout, graphics, logos, trade names, and other content are owned by Hindsight Farms or used with permission and are protected by copyright, trademark, and other laws. "Hindsight Farms" and associated logos and branding may not be used without prior written permission.

You may view and make a reasonable number of copies of Site pages solely for personal, noncommercial reference. No other right or license is granted by implication, estoppel, or otherwise.

6. Contact forms and communications

You are responsible for the accuracy and lawfulness of information you submit. Do not send confidential, sensitive, unlawful, or infringing material through the Site. Sending a message does not guarantee a response, reserve availability, form a contract, or create a duty to provide services.

You authorize us to use the contact information and message you provide to respond to your inquiry, evaluate your request, keep reasonable business records, and communicate about the subject of your message. Our handling of personal information is described in the Privacy Policy.

7. Third-party links and services

The Site may link to or display services operated by others, including maps, social platforms, trainers, and hosting or content providers. Third-party services are provided for convenience and are governed by their own terms and privacy policies.

We do not control and are not responsible for the availability, security, accuracy, content, privacy practices, or conduct of third parties. A link or reference does not necessarily mean Hindsight Farms endorses the third party.

8. Disclaimers

To the fullest extent permitted by law, the Site and all Site content are provided "as is" and "as available," without warranties of any kind, express or implied. Hindsight Farms disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security.

We do not warrant that the Site will be uninterrupted, error-free, secure, free of harmful components, or that defects will be corrected. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, Hindsight Farms and its owners, employees, agents, contractors, trainers, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, business interruption, or other intangible losses arising from or related to the Site or these Terms.

To the fullest extent permitted by law, the total liability of Hindsight Farms for all claims arising from or related to the Site or these Terms will not exceed one hundred United States dollars ($100). These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

10. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Hindsight Farms and its owners, employees, agents, contractors, trainers, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from your unlawful use of the Site, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from the indemnified party's own unlawful conduct.

11. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to any law that gives you a nonwaivable right to bring a claim elsewhere, any legal action arising from the Site or these Terms must be brought in the state or federal courts located in or serving Marin County, California, and you consent to their jurisdiction.

12. General terms

Changes

We may update these Terms from time to time. The revised Terms will be posted on this page with a new effective date. Changes apply prospectively. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is held unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

No waiver or assignment

Our failure to enforce a provision is not a waiver. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a transfer of the Site or our business.

Entire agreement

These Terms and the Privacy Policy are the entire agreement concerning use of the Site. They do not replace or modify any separate written agreement governing boarding, training, property access, employment, or other farm services.
